Software Delivery, Customer Responsibility, and Limitation of Liability

Applications, source code, scripts, templates, modules, and digital products sold by MofidTech are provided according to the description available at the time of purchase and subject to any specific written agreement between MofidTech and the customer.

Unless expressly agreed otherwise in writing, the customer is responsible for installing, configuring, securing, hosting, updating, backing up, maintaining, and operating the purchased application after delivery or deployment.

The customer understands that software may contain bugs, technical limitations, compatibility issues, security vulnerabilities, or dependencies on third-party services. MofidTech does not guarantee that the application will be uninterrupted, error-free, fully secure, compatible with every server or hosting provider, or suitable for every business, legal, or regulatory purpose.

After delivery, download, installation, deployment, modification, or hosting by the customer or a third party, MofidTech is not responsible for:

  • loss, corruption, deletion, or unavailability of data;
  • security incidents caused by weak passwords, misconfiguration, outdated servers, exposed credentials, hosting failures, or third-party services;
  • unauthorized access caused by customer negligence or third-party infrastructure;
  • loss of profit, loss of business, loss of opportunity, reputational damage, or indirect damages;
  • errors caused by modifications made by the customer or another developer;
  • failure to maintain backups, updates, or security measures;
  • legal non-compliance caused by how the customer uses or configures the application.

The customer is responsible for maintaining complete and recent backups of the application, database, media files, configuration files, credentials, and all operational data.

To the maximum extent permitted by applicable law, MofidTech’s total liability for any claim related to a purchased application, digital product, deployment, support, or maintenance service shall not exceed the amount actually paid by the customer for the specific product or service giving rise to the claim.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including in cases of fraud, intentional misconduct, gross negligence, or mandatory consumer protection rights.
