These Terms are drafted in accordance with Moroccan legislation, including but not limited to:

  • Dahir of Obligations and Contracts (قانون الالتزامات والعقود);
  • Law 53-05 on the electronic exchange of legal data;
  • Law 09-08 on the protection of personal data;
  • Law 31-08 on consumer protection, where applicable;
  • Moroccan Copyright Law, Law 2-00 as amended and supplemented by Law 34-05.

If you do not agree with these Terms, please discontinue using the Website and do not purchase, download, install, deploy, or use any application, digital product, or service provided by MofidTech.

1. Purpose of the Website

MofidTech provides:

2. User Eligibility

By accessing the Website, you confirm that:

  • installation services;

  • maintenance services.

By purchasing, downloading, installing, deploying, or using any application, digital product, or service provided by MofidTech, you agree to these Terms of Use and to any additional terms, quotation, invoice, license agreement, or written agreement related to the purchased product or service.

If there is a conflict between these Terms of Use and a specific written agreement signed or accepted between MofidTech and the customer, the specific written agreement shall prevail for the relevant product or service.

14. License to Use Purchased Applications

Unless otherwise stated in writing, applications, source code, scripts, templates, and digital products sold by MofidTech are provided under a limited, non-exclusive, non-transferable license for the customer’s own personal, professional, or internal business use.

The purchase of an application or digital product does not transfer ownership of MofidTech’s intellectual property, source code structure, design, documentation, branding, know-how, business logic, or reusable components.

The customer may not, unless expressly authorized in writing:

  • resell, redistribute, sublicense, or share the purchased application as a competing product;
  • claim ownership of MofidTech’s original code, design, documentation, or branding;
  • remove copyright notices, license notices, or attribution where applicable;
  • use MofidTech’s name, logo, or brand without authorization;
  • reverse engineer, extract, or reuse protected parts of the product for unauthorized commercial purposes.

The customer may modify the application for their own use, unless the product description or specific license agreement states otherwise.

15. Delivery of Digital Products

Digital products may be delivered by download link, email, private repository access, file transfer, customer account access, or any other appropriate electronic delivery method.

The customer is responsible for providing accurate contact, billing, and technical information necessary for delivery.

MofidTech is not responsible for delivery failure caused by incorrect email addresses, blocked emails, inaccessible accounts, expired download links, customer-side technical restrictions, or failure to provide required information.

16. Installation, Deployment, and Customer Infrastructure

Unless expressly agreed otherwise in writing, the customer is responsible for installing, configuring, hosting, securing, updating, backing up, maintaining, and operating the purchased application after delivery.

If MofidTech provides deployment assistance, installation support, or configuration services, such assistance is limited to the agreed scope of work.

Once the application is installed, deployed, modified, hosted, or operated on infrastructure not controlled by MofidTech, including the customer’s server, cloud account, hosting provider, local machine, or third-party platform, the customer remains responsible for the security, availability, configuration, and operation of that environment.

This includes responsibility for:

  • hosting provider selection;
  • server configuration;
  • database configuration;
  • domain and DNS configuration;
  • SSL certificates;
  • firewall rules;
  • environment variables;
  • passwords and credentials;
  • API keys;
  • third-party integrations;
  • backups;
  • updates and security patches;
  • user permissions;
  • monitoring and logs.

17. Customer Data and Legal Compliance

If the customer uses a purchased application to collect, store, process, modify, delete, or display data belonging to users, clients, employees, patients, students, buyers, or any other third party, the customer is responsible for ensuring that such use complies with applicable laws.

The customer is responsible for publishing their own legal documents where required, including but not limited to:

  • Privacy Policy;
  • Terms of Use;
  • Cookie Policy;
  • legal notices;
  • consent forms;
  • data protection notices;
  • refund or cancellation policies;
  • sector-specific legal information.

If the application processes personal data, the customer is responsible for ensuring compliance with applicable data protection laws, including Moroccan Law 09-08 where applicable, and for carrying out any required CNDP declaration, authorization, or legal procedure.

MofidTech may provide technical recommendations, but such recommendations do not constitute legal, financial, tax, medical, accounting, cybersecurity, or regulatory advice.

18. Security Disclaimer

MofidTech makes reasonable efforts to develop and deliver applications with appropriate technical care. However, no software, server, database, hosting environment, internet-connected system, or third-party integration can be guaranteed to be completely secure, uninterrupted, error-free, or immune from cyberattacks, malware, unauthorized access, data corruption, accidental deletion, service interruption, or hosting failure.

After delivery, installation, deployment, modification, or hosting by the customer or by a third party, MofidTech is not responsible for security incidents resulting from:

  • weak or reused passwords;
  • failure to change default credentials;
  • exposed admin panels;
  • exposed API keys or secret keys;
  • incorrect server configuration;
  • outdated software, dependencies, or operating systems;
  • failure to apply updates or security patches;
  • insecure hosting;
  • lack of backups;
  • unauthorized modifications;
  • third-party plugins, libraries, or integrations;
  • negligence or misuse by the customer or their users.

Customers are strongly encouraged to use strong passwords, enable two-factor authentication where available, restrict administrator access, protect credentials, apply updates, monitor logs, and follow recognized security best practices.

19. Data Loss and Backups

Unless otherwise agreed in a separate written hosting, support, or maintenance agreement, MofidTech is not responsible for loss, corruption, deletion, alteration, unauthorized access, or unavailability of data stored in an application after it has been delivered, downloaded, installed, deployed, modified, hosted, or operated by the customer or by a third party.

The customer is solely responsible for creating, testing, storing, and maintaining backups of:

  • the application files;
  • the source code;
  • the database;
  • uploaded media;
  • configuration files;
  • environment variables;
  • credentials;
  • invoices, records, and business data;
  • any other operational data.

The customer should regularly verify that backups are complete, recent, secure, and restorable.

20. Modifications by the Customer or Third Parties

MofidTech is not responsible for errors, bugs, security vulnerabilities, downtime, incompatibilities, or data loss caused by modifications made by the customer, another developer, a hosting provider, a plugin, a third-party service, or any person not authorized by MofidTech.

If the customer modifies the application or allows a third party to modify it, MofidTech may refuse support or require additional fees to audit, repair, secure, or restore the application.

21. Third-Party Services, Libraries, and Integrations

Applications and digital products provided by MofidTech may depend on third-party services, libraries, frameworks, APIs, payment gateways, email providers, hosting services, analytics tools, authentication providers, maps, or other external systems.

MofidTech is not responsible for the availability, security, pricing, policy changes, data practices, failures, outages, vulnerabilities, or legal compliance of third-party services not controlled by MofidTech.

The customer is responsible for reviewing and accepting the terms, licenses, privacy policies, pricing, and technical requirements of any third-party service used with the application.

22. Support and Maintenance

Support, maintenance, updates, corrections, improvements, monitoring, backups, security hardening, and deployment assistance are provided only if expressly included in the product description, invoice, quotation, support plan, maintenance contract, or written agreement.

Unless otherwise agreed in writing, the purchase of an application or digital product does not include unlimited support, lifetime updates, emergency intervention, server administration, cybersecurity monitoring, data recovery, or free customization.

MofidTech may provide limited support at its discretion, but additional work may be subject to separate fees.

23. Refunds and Right of Withdrawal

Refunds, cancellations, and withdrawal rights are handled in accordance with applicable Moroccan law, including consumer protection rules where applicable.

Because applications, source code, scripts, templates, and digital products may be delivered electronically and may be copied, downloaded, accessed, or used immediately after delivery, refund eligibility may be limited once the product has been delivered, downloaded, accessed, customized, installed, or deployed.

For services such as customization, installation, deployment, maintenance, or technical support, refunds may be limited once the service has started or has been fully or partially performed.

Nothing in this section limits any mandatory consumer right that cannot legally be excluded under applicable law.

24. No Warranty of Specific Results

MofidTech does not guarantee that any application, digital product, tutorial, script, configuration, or technical service will produce a specific business result, financial result, SEO result, ranking result, security result, legal compliance result, or operational result.

The customer is responsible for testing the application before using it in production and for verifying that it meets their technical, business, legal, and operational requirements.

25. Limitation of Liability

To the maximum extent permitted by applicable law, MofidTech shall not be liable for any indirect, incidental, special, consequential, punitive, commercial, financial, reputational, or business damages arising from the purchase, download, installation, deployment, modification, hosting, use, misuse, inability to use, or reliance on any application, digital product, source code, script, template, tutorial, support service, or deployment service.

This includes, but is not limited to:

  • loss of profits;
  • loss of business;
  • loss of customers;
  • loss of opportunity;
  • loss of reputation;
  • loss or corruption of data;
  • system downtime;
  • cybersecurity incidents;
  • hosting failure;
  • third-party service interruption;
  • regulatory or legal consequences resulting from the customer’s use of the application.

To the maximum extent permitted by applicable law, MofidTech’s total liability for any claim related to a purchased application, digital product, deployment, support, or maintenance service shall not exceed the amount actually paid by the customer for the specific product or service giving rise to the claim.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including in cases of fraud, intentional misconduct, gross negligence, or mandatory consumer protection rights.

26. Professional Use and Testing Before Production

The customer agrees not to use any purchased application in a live or production environment without first testing it in a safe development or staging environment.

The customer is responsible for verifying:

  • compatibility with their hosting environment;
  • correct configuration;
  • data integrity;
  • access permissions;
  • payment settings;
  • email settings;
  • security settings;
  • backup and restore procedures;
  • compliance with applicable laws.

Use of the application in production is at the customer’s own responsibility unless MofidTech has expressly agreed in writing to provide managed hosting, monitoring, maintenance, or operational responsibility.

27. Managed Hosting or Maintenance Exception

If MofidTech separately agrees in writing to provide managed hosting, maintenance, backups, monitoring, or administration services, the scope of MofidTech’s responsibility will be limited to the specific services described in the relevant contract, quotation, invoice, or written agreement.

Any responsibility not expressly accepted in writing remains the responsibility of the customer.
